Often times circumstances substantially change for one or both spouses after the divorce has been finalized and a judgment of dissolution of marriage has been entered by the court. It is important to remember that unless subsequently modified by a court, the terms of the judgment affecting custody, child support and spousal support will remain in effect and be enforceable until and unless a court order modifying the previous terms has been entered. Therefore, if you believe there has been a substantial change in circumstances since the prior order or judgment was made, you should consult one of our attorneys immediately so that you will not be prejudiced by inaction. A substantial change is often good for one party but less so for the other. However, regardless of the direction of the change, in matters affecting a minor child the court will give priority to the best interests of the child.
